Terms & Conditions – Hotspots Airbrush LLC

These Terms & Conditions (“Terms”) govern your use of the Hotspots Airbrush LLC website and services (the “Site” and “Services”). By accessing our Site, submitting a request, uploading images, or placing an order, you agree to these Terms.

 

If you do not agree, do not use the Site or Services.

1) Company Information

2) Orders & Custom Work

  • Hotspots Airbrush specializes in custom, made-to-order items. By placing an order, you understand and agree that:

  • Colors, shading, and details may vary slightly due to the artistic process, materials, and screen/print differences.

  • Layouts and final appearance may differ slightly from mockups or digital previews.

  • Custom work is created based on the information you provide.

 

3) Proofs, Approvals & Customer Responsibility

  • If we provide a proof/mockup, it is your responsibility to review it carefully before approval. Once you approve a proof (or confirm details in writing), you accept responsibility for: spelling, names, dates, colors, placement, sizing, and design choices.

  • Requests for changes after approval may result in additional fees and/or delays and may not be possible once production begins.

 

4) Customer-Supplied Photos & Content

  • If you upload a photo/image or provide text/design references, you represent that:

    • you own the content or have permission to use it, and

    • it does not violate any third-party rights (copyright, trademark, privacy, publicity, etc.)

  • You are responsible for the quality of images you provide. Low-resolution, blurry, or poorly lit photos may affect print results.

 

5) Intellectual Property & Trademark Notice

  • All original artwork, designs, layouts, and creative elements produced by Hotspots Airbrush remain our intellectual property unless explicitly transferred in writing.

  • We may refuse requests that include copyrighted or trademarked content (logos, characters, celebrities, sports teams, brands, etc.) unless you can show you have the proper rights/permission.

 

6) Pricing, Full Payment & Taxes (Full Payment Required)

  • All prices are shown in U.S. dollars unless stated otherwise. Full payment is required at the time you place your order (or at the time an invoice is issued and paid) before production begins.

  • Prices may change at any time, but price changes will not affect orders already paid.

  •  

  • Sales tax (and any required fees) may be applied at checkout.

  • Payment is processed through Wix and/or Wix-supported payment providers. You agree to provide accurate billing information and authorize us (and our processors) to charge the payment method you provide.

 

 

7) Turnaround Time (Estimates)

  • Because many items are custom-made, turnaround times vary by order type and complexity. Any completion, pickup, or shipment date we provide is an estimate, not a guarantee.

 

  • Turnaround times may be affected by:

    • design complexity and order volume

    • customer delays in confirming details (if proof/approval is required)

    • supply availability

    • peak seasons and holidays

    • carrier delays and weather events

 

8) Shipping, Delivery & Pickup (Both Available)

  • Shipping

    • If you choose shipping:

      • You are responsible for entering a complete and accurate shipping address at checkout.

      • Shipping fees (if applicable) are shown at checkout.

      • Once the carrier shows an order as delivered, Hotspots Airbrush LLC is not responsible for loss, theft, or misdelivery.

    • If a package is returned due to an incorrect address, incomplete address, or failed delivery attempt, you are responsible for any reshipment fees.

 

  • Local Pickup

    • If you choose local pickup:

    • Pickup instructions and timing will be provided by email, text, or order status update.

    • Please pick up your order within 7 days of notification that it is ready, unless we agree otherwise in writing.

    • Orders not picked up after 30 days may be considered abandoned and may be disposed of at our discretion after reasonable notice, without refund (because the items are custom).

 

9) Changes, Cancellations & Refunds (Custom Orders)

Because most items are customized:

  • All custom orders are final sale once production begins.

  • We may allow a cancellation only before production starts, at our discretion.

  • If a cancellation is approved, we may deduct costs already incurred (design time, materials, setup fees) and refund the remaining balance, if any.

  • If an order is placed with incorrect details and production has not started, contact us immediately. Changes requested after production begins may not be possible and may require a new order.

 

10) Defects, Errors & Reprints

  • If we make an error that is clearly inconsistent with your approved proof or written instructions, contact us within 3 days of delivery or pickup and include:

your order number/name

clear photos of the issue

a description of the problem

If approved, we may offer (at our discretion):

  • a rework/reprint, or

  • store credit, or

  • a partial/full refund

  • We are not responsible for:

customer-provided spelling/design choices

changes requested after approval

limitations from customer-supplied photo quality

damage after pickup/delivery

normal wear and tear

 

11) Chargebacks & Disputes

If you believe there is an issue with your order, contact us first so we can try to resolve it.

 

Unjustified chargebacks (especially after approval/production) may result in refusal of future service and/or collection actions as allowed by law.

 

12) Artwork Sharing & Privacy Requests

We may photograph, record, or display completed work (including photo transfers) for our portfolio and marketing (website, social media, print, and other channels).

Privacy Request: If you want your order kept private, you must tell us in advance or at the time of ordering (for example: “KEEP PRIVATE” in order notes). We will not post it publicly. We may still retain and use images internally for documentation and quality control.

 

13) Website Use & Prohibited Conduct

You agree not to misuse the Site, attempt unauthorized access, interfere with Site operations, or submit unlawful, harmful, or infringing content.

 

14) Disclaimer of Warranties

Products and services are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted or error-free.

 

15) Limitation of Liability

To the fullest extent permitted by law, Hotspots Airbrush LLC will not be liable for indirect, incidental, special, consequential, or punitive damages.

 

Our maximum liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.

 

16) Indemnification

You agree to indemnify and hold harmless Hotspots Airbrush LLC from claims, damages, or expenses arising from your uploaded content, your order instructions, or your violation of these Terms or third-party rights.

 

17) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

 

18) Changes to These Terms

We may update these Terms at any time by posting an updated version on this page. Continued use of the Site after changes means you accept the updated Terms.
